Why is Notre Dame Getting a Pass?

Notre Dame is now affiliated with the ACC and play 6 games a year against ACC schools. They lost to Clemson and if they were actually IN the ACC they wouldn't even be playing for the ACC championship if Clemson won out. Why on earth would the selection committee choose ND if they couldn't even win the ACC?
